Statement of the press conference released to media addressed by Dr. Agnishekhar Convener & Dr. Ajay Chrungoo Chairman Panun Kashmir on Sunday April 7, 2019 at Press Club Jammu.
The statements from the top leaders of National Conference (NC) and Peoples Democratic Party (PDP) that Jammu and Kashmir will cease to be a part of India if Article 370 and 35-A is removed are constitutionally baseless as well as seditious in import. Not only such statements, but many more from the leaders of these parties that concern with Foreign Policy as well as National security, smack of a spirit of sedition. We appeal to Election Commission of India to take notice of the seditious nature of the election campaign launched by NC and PDP in Jammu and Kashmir and ban their candidates from contesting the forth coming Parliamentary elections in the state.
Panun Kashmir wants to state it clearly that Jammu and Kashmir became part of India due to the process started by India Independence Act of the British Parliament and Instrument of Accession and not because of the inclusion of Article 370 and 35-A in the Constitution of India. Also Jammu and Kashmir is part of indivisible Union of India due to Article 1 of Constitution of India and nothing can change this reality.
Consent or will of people of Jammu and Kashmir had no role in the accession of Jammu and Kashmir as it acceded with India exactly as other princely States did by signing of the Instrument of Accession. Both the Muslim League as well as British government had refused to refer the issue of accession of Princely states to the will of people living in these states.
We want to make it clear that Accession of Jammu and Kashmir with the Union of India took place without any condition attached to it. It should be clearly known that even the Working Committee of National Conference accepted and endorsed the accession without any conditionality attached to it.
The campaign unleashed by the leaders of NC and PDP that accession of Jammu and Kashmir with India was conditional and Article 370 forms the only bridge between Jammu and Kashmir and India in case it is removed it will lead to separation of the state from India is preposterous and has seditious connotations.
It should be clear to all that Constitution of India is declaratory of Republic of India. The nation of India existed well before the creation of Constitution of India and even if the whole Constitution is changed the nation of India will not fall apart. Constitutions of many countries in the world have been changed many times. Changing of constitution or even scrapping it lock stock and barrel does not dissolve a nation. Pakistan changed its Constitution and did not fall apart because of this. Germany changed its Constitution and continued to exist as the nation of Germany. Same is true of Russia and many other countries.
National Conference and Peoples Democratic Party have embarked upon a brazenly seditious and secessionist campaign. They are virtually acting as over ground flanks of Pakistan and the separatist establishment in Jammu and Kashmir. They have rejected almost every view and policy of Government of India pertaining to Foreign Affairs, Defense and Internal Security. Election Commission of India cannot close its eyes to the seditious election campaign launched by both these parties.
It is time that government of India realizes that both NC and PDP are formations committed to wrecking the State from within. They have become launching pads for subversion. Their leaders are not mascots of Indian democracy but commanders of a subversive war which aims at destroying the democratic and secular order from within.
